The seventh day of the Seth Fontenot murder trial wrapped up on Tuesday.
An intense cross examination took place on Tuesday by the state against the defendant, Seth Fontenot. Assistant District Attorney J. Prather continued to attack the details stated by Fontenot, in his original statement, to police. Prather also continued to attack the details of what Fontenot testified to in court.
According to Officer Beyard’s testimony, Fontenot told Beyard (who responded to the 911 call) that his girlfriend woke him up on the night of the incident. However, Fontenot and his girlfriend testified that Seth was the one who was awakened by the sound of someone pulling on door handles. Another discrepancy is where Seth Fontenot, again, according to Beyard’s testimony, said he “did not see any subjects” on the night of the incident.
In an interview the following day of the incident, Fontenot says he saw a “figure” running from his truck through the neighbor’s yard in the direction of where, he testified, the truck driven by Cole Kelley on the evening (in question) was parked. The state also made strong arguments to prove that Fontenot could see inside the truck at the time of the shooting. In his defense, Fontenot’s attorney had several witnesses take the stand and testify that the truck’s windows, with repairs to the back glass, had not been altered since the incident. This coincides with experiments done by the defense to prove Seth, nor anyone else, could see inside that vehicle.
To wrap up the trial on Tuesday, the defense called on Larry Benoit, PhD as an expert in psychology. He went on record to say that the adolescent brain or someone of Seth’s age is not as developed as someone in their mid 20s and the motions are intense. The motions can also be out of balance.
During cross-examination, ADA Prather asked one question, “Does that justify an 18-year-old killing someone?” and Dr. Benoit replied, “No.”
After that was spoken, the defense rested and Judge Rubin then decided to recess until 10 am on Wednesday where closing arguments will take place.
