LAFAYETTE, La. (The Advertiser)- A week after the Lafayette City-Parish Council ignored an Attorney General’s Office opinion and passed an ordinance to amend its newly implemented charter, Attorney General Jeff Landry explained why the council’s decision may not hold up if it goes to court.
In an interview with The Daily Advertiser on Tuesday, Landry cited a 2018 decision by the Supreme Court of Louisiana in which the high court ruled St. Tammany Parish had to recognize the district attorney as its legal adviser as outlined in the parish’s home rule charter.
The Parish Council had previously passed two ordinances to attempt to establish a new legal department, but the Supreme Court ruled the district attorney would remain the parish’s legal adviser and that the ordinances did not amend the charter.
“What’s going on here (in Lafayette) is absolutely no different,” Landry said.
