Court records in the Seth Fontenot murder case,removed from public view last week, were ordered unsealed again Wednesday.
It’s the latest development in a legal tug-of-war over which documents, if any, should be sealed and which should be open to the public.
The entire court file in the Seth Fontenot murder case was pulled from public view last week. Anyone trying to view the file via the Lafayette Parish Clerk of Court’s online database found no trace of a murder case against Fontenot, 20, of Lafayette.
Fontenot is accused of the fatal shooting in February 2013 of Austin Rivault, 15, and the wounding of two other teens.
The only pending case listed against Fontenot this afternoon was for two 2012 charges of distributing amphetamine. But the files should be available for public view later today or Thursday, according to Louis Perret, Lafayette Parish Clerk of Court.
On Feb. 2, visiting Judge Harry Randow — sitting in for an ailing Judge Edward Rubin — ordered some of the previously sealed documents in the Fontenot case unsealed. Last week, Randow reversed his decision, ordering the entire file sealed pending an appeal by Assistant District Attorney J.N. Prather Jr. But later in the week, Randow reversed that decision, ordering some files unsealed.
“In the midst of unsealing everything we hit a glitch in the (computer) system,” Sally Lane, supervisor, deputy clerk of court, said today.
The computer glitch was repaired, but the Clerk of Court’s Office did not unseal any files until consulting with its attorney and Randow, Clerk of Court Louis Perret told The Daily Advertiser this afternoon.
Randow clarified his order today and all but 13 files in the Fontenot case will be unsealed, Perret said.
Fontenot faces one count of first-degree murder and two counts of attempted first-degree murder in Rivault’s death and the shooting of William Bellamy and Cole Kelley, who also were 15 years old at the time. The district attorney’s office will not seek the death penalty.
